Total Loss and General Average Insurance.

We fully realize that it is customers attitude that they hand over their cargoes in good faith to RMR Shipping and expect from RMR that they will transport customers goods to the port of destination in the same good order and condition as customers have delivered their goods at the port of loading.

RMR considers customers attitude as logic and RMR will do their utmost to full fill customers expectations,  however there are circumstances that, beyond RMR’s control, damages to the cargoes, even total loss, washed overboard of cargoes etc. can occur.

RMR as owners and charterers haven taken out adequate insurances to cover their risk under the conditions of the bills of lading, however there are circumstances that on basis of the bill of lading conditions RMR as well as their Insurance Company have the legal right to reject claims from customers, and thus do not pay out, and in this respect refer to circumstances considered as FORCE MAJEURE when for instance a vessel faces extreme bad weather, is faced with engine problems etc. etc.

There are even worse case scenarios where a vessel in problems is asking for salvage assistance etc. and where Owners declare GENERAL AVERAGE, which means that all the cargo interests have to participate in all the salvage costs, delays etc. for reasons that this was done, amongst others, to safeguard customers goods.

In principle it is customers obligation to take out a CARGO INSURANCE, which will start to pay out when a Shipping Line and their Insurance Company are in a position to legally reject a claim under the conditions of the bills of lading, for reasons as stated above, and by which also the consequences for GENERAL AVERAGE are covered.

Since we know that, in general, it is not customers intention to take out any CARGO INSURANCE, we as RMR have decided to take out a special CARGO INSURANCE, which covers TOTAL LOSS as well as GENERAL AVERAGE, in which customers can participate.

To cut a long and complex story short RMR will charge as from the 1st  of February 2008 to all customers an extra cargo insurance premium for total loss and/or general average as follows:

Euro  50,-  per 2nd hand RoRo unit               with an insured value of euro 10.000,-Euro  25,-  per 2nd hand Van /car                 with an insured value of euro   3.000,-Euro 200,- per brand new RoRo unit             with an insured value of euro 40.000,-

If a double stacked trailer will be shipped (total 3 pieces/objects) premium is euro 150,- for an insured value of euro 30.000,- etc.

The 10.000/3.000/40.000 are minimum values and when customers need a higher insured value they have to report this to us and premium will be increased pro rata by 0,5%.

RMR as the first and only Shipping Line offering this possibility, is of the opinion that with this extra insurance, with a small contribution from customers side, a lot of problems, frustrations etc. can be avoided whenever an accident takes place, which will optimize the relation between customers and RMR.

Of course we can not force customers to participate in this insurance, on which please inform us in writing in time, however they have to bear in mind that, in this case, claims will be handled off purely according to the conditions of the relevant bills of lading.
